Wage and hour wage complaint process.

A wage complaint is information provided to the Department which will be reviewed by the Department of Labor Inspection Division.  If the information you provide rises to a violation of law falling under our jurisdiction, the Department may choose to contact the employer via a courtesy call, warning letter, or investigation.  You will be contacted in advance if we believe our communication with the employer could result in your identity being learned. 

When to File a Wage Claim vs. a Wage Complaint 

A wage claim is different from a wage complaint.    

A wage claim is a request for a hearing against your employer. Any employee who is due unpaid wages may file a wage claim within 36 months from when the wages are due. Your employer will be made aware of the wage claim should you elect to file one and will have the opportunity to respond. Both parties will have an opportunity to appear and be heard at an administrative hearing. At the hearing you will have the opportunity to present evidence about your claim to a hearing officer.
